1. Website Information Accuracy
Distances, travel times, route descriptions, estimated costs, and pricing published on the website are informational. Actual conditions can vary. The binding fare is the one produced and confirmed through the official reservation process for the exact itinerary.
2. Acceptance of Terms
Reservations and transportation are subject to these Terms. Completing a booking or payment confirms acceptance of the Terms. The booking party must be at least 18 and legally able to enter an agreement.
3. Booking Policy
Advance reservations are recommended and remain subject to vehicle availability. Short-notice requests may be accepted but are not guaranteed. Pickup information, terminal details, flight numbers, and schedule information must be accurate, and times are scheduled in Pacific Time.
4. Service Disclaimer & Liability
Traffic, weather, road closures, airport operations, accidents, and other outside conditions can affect service. Customers are responsible for allowing sufficient travel time. To the extent permitted by California law, indirect or consequential losses are excluded, and trip-related liability is limited to the amount paid for the affected trip.
5. Luggage
The current terms describe a standard allowance of one suitcase and one carry-on per passenger, with size and weight guidance. Oversized, excessive, sports, or specialty luggage should be disclosed before the trip. Except where applicable law provides otherwise, luggage liability is limited as stated in the Terms.
6. Holiday Surcharges
A 50% holiday surcharge may apply from December 24 through December 26 and from December 31 through January 1. Holiday and special-event reservations may also have stricter cancellation conditions.
7. Payment Methods
Major credit cards may be accepted through the secure reservation system or approved payment links. Official payment processors may include Stripe, Square, or other authorized providers.
8. Toll Charges
Applicable toll-road charges are included in standard fares as described in the current Terms, while special access charges or restricted-access surcharges may be excluded where applicable.
9. Re-Booking Policy
Chauffeurs are not authorized to privately accept future reservations from passengers. New transportation must be booked through official Emelx channels; side arrangements are not affiliated with or insured by Emelx.
10. Force Majeure
Emelx is not responsible for service disruption caused by events outside reasonable control, including severe weather, natural disasters, traffic incidents, road closures, government restrictions, labor actions, flight cancellations, or airline delays.
11. Pricing Policy
Fares are based on factors such as trip distance, vehicle positioning, and vehicle type. Confirmed transportation uses flat-rate pricing rather than a meter or rideshare-style surge pricing. Optional services, route changes, additional stops, excess waiting, or holiday surcharges can be itemized separately before payment. Prices can change until confirmed.
12. Waiting Time
Airport pickups currently include 60 minutes of complimentary waiting for domestic arrivals and 80 minutes for international arrivals, starting from actual landing time. Additional airport waiting may be billed at $50 per hour on a prorated basis. Non-airport pickups currently include 15 complimentary minutes.
13. Cancellation & Refund Policy
Cancellations made more than 48 hours before pickup may receive a refund less a fee equal to 20% of the fare or $20, whichever is greater. Cancellations within 48 hours and no-shows are non-refundable. Holiday or high-demand reservations may become non-refundable within 72 hours.
14. Terms of Carriage
Passengers are responsible for allowing enough travel time. Added stops or route changes can produce additional charges. Child safety seats may be available by advance request; responsibility for child-seat use and installation remains with the parent or guardian as stated in the current Terms.
15. Passenger-Requested Stops & Delays
Emelx is not responsible for delays caused by passenger-requested stops, significant route changes, or the passenger being late to the scheduled pickup. Additional itinerary changes can increase the fare.
16. Account Customers
Corporate or account invoices are due within 10 business days unless another written arrangement applies. Service may be suspended for overdue balances.
17. Data & Privacy
Reservation and service information can include passenger identity, contact details, locations, payment information, and service communications. Processing is subject to applicable privacy law and the separate Emelx Privacy Policy.
18. Governing Law
California law governs the Terms. Disputes are subject to courts in Orange County, California. If one provision is unenforceable, the remaining provisions continue in effect.
19. Updates
Emelx may revise the Terms. Updated Terms become effective when published on the website unless another effective date is stated.
20. Alcoholic Beverage & Hospitality Amenity Policy
Emelx does not sell alcohol. Alcoholic beverages, if arranged as a complimentary hospitality amenity in advance, are subject to California law and age restrictions. Only persons age 21 or older may consume alcohol; alcohol is not permitted where an underage passenger is present, and the chauffeur may remove alcohol or end service when necessary for safety or legal compliance.
21. Passenger Conduct
Passengers must behave safely and respectfully. Service can be refused or ended without refund when conduct creates a safety risk, violates law, threatens or harasses the chauffeur, involves illegal activity, causes vehicle damage, or interferes with safe operation.
22. Vehicle Damage & Cleaning Fees
Passengers are responsible for damage they cause. Professional cleaning or repair costs may be charged, and the current Terms provide for a minimum $250 sanitation fee for biohazard contamination requiring professional cleaning.
23. Smoking Policy
Smoking, vaping, and cannabis use are prohibited inside Emelx vehicles.
24. Lost Property
Emelx is not responsible for items forgotten, lost, or stolen in a vehicle, although reasonable efforts may be made to help locate property. Customers remain responsible for valuables such as cash, jewelry, and electronics.
25. Non-Discrimination & Service Animals
Emelx states that it complies with applicable federal and California non-discrimination rules, including the ADA. Trained service animals accompanying passengers with disabilities are permitted without additional charge. Other animals may be accepted at Emelx’s discretion and can be subject to cleaning conditions.
26. Pre-Arranged Transportation Requirement
Emelx operates as a California Charter-Party Carrier providing prearranged transportation. Vehicles do not accept street hails.
27. Airport No-Show Policy
If the passenger does not appear within the complimentary waiting period and cannot be reached using the supplied contact information, the booking may be treated as a non-refundable no-show and the chauffeur may be released.
28. Intoxicated Passenger Policy
Service may be refused or ended when a passenger’s level of intoxication creates a safety concern or interferes with lawful vehicle operation.
29. Interior Contamination Fee
Interior contamination that requires professional sanitation can result in a minimum $250 cleaning charge.
30. Vehicle Interior Protection
Passengers are responsible for interior damage caused by luggage, personal property, beverages, or negligent conduct.
31. Chauffeur Arrival Verification
Operational records such as dispatch logs, GPS data, passenger communications, and flight-tracking information may be used to verify service performance if a dispute arises.
32. Passenger Contact Responsibility
Passengers must provide a reachable phone number and keep it able to receive calls or messages around the scheduled service.
33. Pickup Location Responsibility
Passengers are responsible for proceeding to the designated pickup location communicated for the reservation.
34. Corporate & Third-Party Bookings
A person or company booking on behalf of someone else is responsible for providing accurate passenger contact information and communicating the trip instructions to the traveler.
35. Chauffeur Assignment
A specific chauffeur cannot be guaranteed. Assignments may change because of operations, scheduling, or vehicle availability while Emelx seeks to maintain consistent service standards.
36. Payment Authorization & Chargeback Policy
Completing payment authorizes the confirmed reservation amount. Reservation records, dispatch logs, GPS data, and communications may be supplied to payment processors during a dispute. Fraudulent chargebacks may result in refusal of future service. When the reserved vehicle and chauffeur are dispatched and made available as scheduled, the service may be treated as fulfilled for billing purposes.
37. Electronic Acceptance of Terms
Booking through the website, reservation system, email, payment link, or another official channel constitutes electronic acceptance. A person booking for others represents that they have authority to accept the Terms for the passengers included in the reservation, and passengers are deemed to accept the Terms when using the service.
