Emelx Chauffeur & Black Car Service operates as a licensed California Charter-Party Carrier under the authority of the California Public Utilities Commission (CPUC). All transportation services are provided exclusively on a pre-arranged basis in accordance with applicable California regulations governing charter-party carriers.
By booking or using Emelx transportation services, the customer agrees to these Terms & Conditions and acknowledges that transportation is provided as a pre-arranged private service.
1. Website Information Accuracy
The information provided on this website regarding travel times, distances, estimated costs, or pricing—including but not limited to quoted fares, fees, travel durations, and routes—is provided for general informational purposes only.
Actual travel times may vary due to traffic conditions, weather, road closures, airport operations, and other factors beyond our control.
Estimated costs or fares listed on this website are not guaranteed and do not constitute a binding offer or contract.
For accurate pricing, passengers must enter the exact pickup and drop-off locations through the official Emelx reservation system, which provides real-time quotes based on trip distance and vehicle type.
2. Introduction & Acceptance of Terms
All services provided by Emelx are subject to these Terms & Conditions.
By making a reservation through the Emelx website, phone, email, or other official booking channels and completing payment, the customer acknowledges that they have read, understood, and agreed to these Terms.
By placing a reservation, the customer confirms that they are at least 18 years of age and legally capable of entering into a binding agreement.
3. Booking Policy
Reservations should be made at least 24 hours in advance, subject to vehicle availability.
Last-minute bookings may be accepted when available but are not guaranteed.
If a booking is made within 24 hours and a vehicle cannot be assigned, Emelx reserves the right to cancel the reservation and issue a full refund if payment has already been made.
All pickup times must be scheduled according to Pacific Time (California).
Passengers are responsible for providing accurate pickup details including addresses, terminal information, and flight numbers.
While Emelx monitors flight arrival times, passengers remain responsible for notifying Emelx of flight number changes or airline diversions.
4. Service Disclaimer
Emelx is not responsible for passengers missing flights, trains, cruise departures, or scheduled events due to delays caused by traffic, weather, accidents, road closures, or other conditions outside our control.
Passengers are strongly encouraged to allow sufficient travel time and obtain appropriate travel insurance.
Travel times and routes are estimates only and do not constitute a guarantee.
Emelx operates as a charter-party carrier under California law and does not act as a common carrier. Transportation services are provided on a best-efforts basis, and Emelx does not guarantee arrival times due to conditions beyond its control including traffic congestion, weather, road closures, airport operations, or other unforeseen circumstances.
To the maximum extent permitted by California law, Emelx shall not be liable for any indirect, incidental, consequential, or special damages arising from transportation services, including but not limited to missed flights, missed connections, lost profits, business interruptions, or additional travel expenses.
In all cases, Emelx’s total liability arising from or related to a transportation service shall not exceed the total amount paid for the specific trip giving rise to the claim.
Passengers are responsible for ensuring adequate travel time when booking transportation to airports, cruise terminals, or scheduled events.
5. Luggage
Standard luggage allowance per passenger includes:
• 1 suitcase (maximum 80 × 45 × 25 cm / 31 × 18 × 10 in, approximately 33–44 lb / 15–20 kg)
• 1 carry-on bag (maximum 55 × 40 × 20 cm / 22 × 16 × 8 in, approximately 13–18 lb / 6–8 kg)
Passengers must notify Emelx in advance of oversized luggage, excessive baggage, sports equipment, or specialty items.
Except in cases of gross negligence or willful misconduct, Emelx shall not be liable for loss or damage to luggage.
Where liability applies, Emelx’s responsibility shall not exceed the total fare paid for the trip.
6. Holiday Surcharges
A 50% holiday surcharge may apply during:
• December 24 – December 26
• December 31 – January 1
Holiday and special-event reservations may be subject to stricter cancellation terms.
7. Payment Methods
Major credit cards may be accepted through the secure Emelx booking system or approved payment links.
Card payments completed through official payment processors (including Square or Stripe) are processed securely.
8. Toll Charges
Fares include applicable toll road charges but may exclude special access fees or restricted access surcharges where applicable.
9. Re-Booking Policy
Private chauffeurs are not authorized to accept bookings directly from passengers.
All transportation services must be reserved through official Emelx booking channels.
Unauthorized arrangements are not insured or affiliated with Emelx.
10. Force Majeure
Emelx shall not be liable for delays, cancellations, or service disruptions caused by events beyond reasonable control including:
• severe weather
• natural disasters
• traffic accidents
• road closures
• government restrictions
• labor strikes
• flight cancellations or airline delays
11. Pricing Policy
Transportation fares are calculated based on the distance of the trip, the distance required for the vehicle to travel from its operating base, and the selected vehicle type.
Emelx provides flat-rate pricing, meaning fares are not calculated based on travel time, traffic conditions, or the number of passengers.
Once a reservation is confirmed, the quoted fare will not increase due to traffic delays or congestion, and Emelx does not apply surge pricing.
Additional services such as meet-and-greet assistance, additional stops, route changes, waiting time beyond the complimentary allowance, or holiday surcharges will be clearly itemized before payment.
Prices are subject to change until a reservation has been confirmed through the Emelx reservation system.
Clerical or typographical errors in pricing may be corrected without liability.
12. Waiting Time
Airport pickups include:
• 60 minutes complimentary waiting time for domestic arrivals
• 80 minutes complimentary waiting time for international arrivals
Waiting time begins from the actual flight landing time.
After the complimentary waiting period, waiting time may be charged at $50 per hour, prorated.
Non-airport pickups include 15 minutes of complimentary waiting time.
13. Cancellation & Refund Policy
Cancellations made more than 48 hours before pickup may receive a refund minus a cancellation fee equal to 20% of the fare or $20 (whichever is greater).
Cancellations within 48 hours of pickup or no-shows are non-refundable.
Holiday and high-demand reservations may be non-refundable within 72 hours.
14. Terms of Carriage
Passengers must ensure they allow adequate travel time for airport check-in or scheduled events.
Additional stops or route changes may incur additional charges.
Child safety seats may be available upon request but installation remains the responsibility of the parent or guardian.
14A. Passenger-Requested Stops & Delays
Emelx is not responsible for delays caused by passenger-requested stops, route changes, or late passenger arrival at the pickup location.
Additional stops or significant route changes may result in additional charges.
15. Account Customers
Corporate or account invoices must be paid within 10 business days unless otherwise agreed.
Emelx reserves the right to suspend account services for overdue balances.
16. Data & Privacy
Emelx collects and processes personal information in connection with reservations, transportation services, and customer support.
Such information may include passenger names, contact details, pickup and drop-off locations, payment information, and communications necessary to provide transportation services.
Personal data is processed in accordance with applicable privacy laws, including the California Consumer Privacy Act (CCPA) and other relevant U.S. privacy regulations.
For detailed information regarding how Emelx collects, uses, stores, and protects personal information — including consumer rights relating to access, correction, or deletion of personal data — please refer to the Emelx Privacy Policy available on this website.
By using Emelx services, customers acknowledge that their personal information may be processed as described in the Emelx Privacy Policy.
17. Governing Law
These Terms & Conditions are governed by the laws of the State of California.
All disputes shall be subject to the jurisdiction of the courts located in Orange County, California.
If any provision of these Terms is deemed unenforceable, the remaining provisions remain in full force.
18. Updates
Emelx reserves the right to modify these Terms & Conditions at any time. Updated terms become effective immediately upon publication on the Emelx website.
19. Alcoholic Beverage & Hospitality Amenity Policy
Emelx Chauffeur & Black Car Service operates as a licensed California Charter-Party Carrier (TCP #41954-B) and does not sell alcoholic beverages.
Any champagne, wine, or spirits that may be present in the vehicle are provided solely as a complimentary hospitality amenity upon advance passenger request and are not sold or itemized as a retail product or service. The transportation rate is not increased based on the selection of any hospitality amenity.
Passengers consuming alcoholic beverages must be 21 years of age or older, and valid government-issued identification may be required.
Passengers may bring their own alcoholic beverages provided that all passengers consuming alcohol are 21 years of age or older. Emelx is not responsible for the storage, condition, or handling of passenger-provided alcohol.
If any passenger under the age of 21 is present, alcoholic beverages will not be permitted in the vehicle.
In accordance with California Public Utilities Code Section 5384.1, the consumption of alcoholic beverages by individuals under the age of 21 is prohibited. The chauffeur reserves the right to remove alcoholic beverages or terminate service if necessary to ensure compliance with California law or if passenger conduct, including excessive intoxication, compromises safety.
Hospitality amenities involving alcoholic beverages are arranged only upon passenger request and are not proactively offered by Emelx.
Alcohol consumption inside charter-party carrier vehicles must comply with applicable California laws and regulations, and passengers are responsible for ensuring their conduct remains in compliance with such laws.
20. Passenger Conduct
Passengers must behave respectfully and safely during transportation.
Service may be refused or terminated without refund if passenger behavior creates a safety risk or violates applicable laws.
Examples include but are not limited to:
• illegal activity
• harassment or threats toward the chauffeur
• excessive intoxication
• damage to the vehicle
• behavior that interferes with the safe operation of the vehicle
Emelx reserves the right to refuse service or terminate a trip if a passenger appears intoxicated to a degree that may endanger safety, violate California law, or interfere with chauffeur operation.
21. Vehicle Damage & Cleaning Fees
Passengers are responsible for damage caused to the vehicle.
Professional cleaning or repair costs may be charged when required.
A minimum sanitation fee of $250 may apply for biohazard contamination requiring professional cleaning.
Repair or cleaning charges may be applied to the payment method used for the reservation.
22. Smoking Policy
All Emelx vehicles are strictly non-smoking.
Smoking, vaping, or cannabis use inside the vehicle is prohibited.
23. Lost Property
Emelx is not liable for lost, stolen, or forgotten items left in vehicles, though reasonable efforts will be made to assist in recovering lost property.
Emelx is not responsible for cash, jewelry, electronics, or other valuables carried by passengers.
24. Non-Discrimination & Service Animals
Emelx Chauffeur & Black Car Service complies with applicable federal and California non-discrimination laws, including the Americans with Disabilities Act (ADA).
Passengers with disabilities are welcome to use Emelx transportation services.
Trained service animals accompanying passengers with disabilities are permitted in Emelx vehicles at no additional charge, in accordance with applicable law.
Passengers traveling with service animals are encouraged to notify Emelx in advance when possible so that appropriate vehicle arrangements can be made.
Animals that do not qualify as service animals under applicable law, including pets or emotional support animals, may be accepted at Emelx’s discretion and may be subject to additional cleaning fees.
25. Pre-Arranged Transportation Requirement
Emelx operates exclusively as a pre-arranged transportation service in compliance with California Charter-Party Carrier regulations.
Vehicles may not accept street hails.
26. Airport No-Show Policy
If a passenger does not appear within the complimentary waiting period and cannot be reached using the contact information provided during booking, the reservation will be considered a no-show and is non-refundable.
In such cases the chauffeur may be released from the pickup location and the trip will be treated as a completed reservation for billing purposes.
27. Intoxicated Passenger Policy
Service may be refused or terminated if a passenger appears intoxicated to a degree that compromises safety.
28. Interior Contamination Fee
Interior contamination requiring professional sanitation may result in a minimum $250 cleaning fee.
29. Vehicle Interior Protection
Passengers are responsible for any interior damage caused by luggage, personal items, beverages, or negligent behavior.
30. Chauffeur Arrival Verification
Emelx maintains records including:
• dispatch logs
• GPS vehicle data
• passenger communication records
• flight tracking information
These records may be used to verify service performance during disputes.
31. Passenger Contact Responsibility
Passengers must provide a reachable phone number and ensure it can receive calls upon arrival.
32. Pickup Location Responsibility
Passengers must proceed to the designated pickup location communicated by the chauffeur.
33. Corporate & Third-Party Bookings
Third parties making reservations are responsible for providing accurate passenger details and communicating trip instructions.
34. Chauffeur Assignment
While Emelx strives to maintain consistent service quality, specific chauffeurs cannot be guaranteed. Chauffeur assignments may change due to operational requirements, scheduling adjustments, or vehicle availability.
35. Payment Authorization & Chargeback Policy
By completing payment, the customer authorizes the total reservation amount and accepts the agreed transportation service.
Emelx may provide reservation records, dispatch logs, GPS data, and communication records to payment processors in response to disputes or chargebacks.
Fraudulent chargebacks may result in permanent service refusal.
If the reserved vehicle and chauffeur were dispatched and made available at the scheduled pickup location and time, the transportation service will be considered fulfilled for billing purposes.
36. Electronic Acceptance of Terms
By booking transportation services through the Emelx website, reservation system, email confirmation, payment link, or other official booking channels, the customer acknowledges and agrees to these Terms & Conditions.
Completion of a reservation or payment constitutes electronic acceptance of these Terms, whether the reservation is made directly by the passenger or by a third party on the passenger’s behalf.
The person making the reservation represents and warrants that they have the authority to accept these Terms & Conditions on behalf of all passengers included in the booking.
Passengers using Emelx transportation services are deemed to have accepted these Terms & Conditions upon entering the vehicle.
By booking transportation with Emelx Chauffeur & Black Car Service, the customer acknowledges and agrees to these Terms & Conditions.
