Terms and Conditions of Emelx
1. Website Information Accuracy
The information provided on this website regarding travel times, distances, estimated costs, or pricing—including but not limited to quoted fares, fees, travel durations, and routes—is provided for general informational purposes only.
Actual travel times can vary due to factors such as traffic, weather, road conditions, and service availability in compliance with California and U.S. federal regulations.
Estimated costs or fares listed here are not guaranteed and do not constitute a binding offer or contract.
For accurate pricing, including exact fares, applicable surcharges, and taxes, please enter your precise pickup and drop-off locations on our reservation page. This ensures you receive a real-time, location-specific quote.
Please consult official sources (e.g., city transit websites, relevant regulatory agencies, airport authority sites) and/or the official Emelx reservation system for the most current, precise, and binding travel information.
2. Introduction
All business between clients and Emelx is conducted under the terms and conditions set out here. By making a booking through our website, phone, or email, you acknowledge and agree to be bound by these Terms and Conditions.
By placing an order, you confirm that you are at least 18 years of age and legally capable of entering into a binding contract.
3. Booking Policy
- Bookings should be made at least 24 hours in advance. Last-minute bookings are subject to fleet availability.
- If a booking is made within 24 hours and vehicles are unavailable, Emelx reserves the right to cancel and issue a full refund if prepaid.
- For bookings within 24 hours, please email info@emelx.com to confirm availability before booking online.
- Emelx reserves the right to cancel or modify any reservation at any time without prior notice due to operational needs, safety concerns, or force majeure events.
- Refunds are not issued to passengers who do not wait for their allocated driver and use alternative transport.
- Ensure all pickup times are based on the California time zone.
- In case of serious flight delays, notify Emelx or the assigned driver immediately.
4. Service Disclaimer
Emelx is not responsible for passengers missing flights, trains, or cruise ships due to delays caused by traffic, weather, accidents, or road closures beyond our control.
We recommend all passengers obtain appropriate travel insurance.
All travel times, routes, and cost estimates displayed on our website or provided via phone/email are approximate and for informational purposes only. They do not constitute a guarantee.
Prices may change at any time without notice. A fare is only binding when confirmed via a completed booking. For accurate pricing, enter your exact pickup and destination on the Emelx reservation page.
5. Luggage
- Standard allowance: 1 suitcase (80 x 45 x 25cm, 15–20kg) and 1 carry-on (55 x 40 x 20cm, 6–8kg) per passenger.
- Notify Emelx of large or multiple pieces of luggage in advance to ensure proper vehicle allocation.
- Drivers may request advance payment for cash journeys exceeding 10 miles if deemed necessary.
6. Holiday Surcharges
A 50% surcharge applies on:
- 24th Dec 18:00 – 26th Dec 23:59
- 31st Dec 18:00 – 1st Jan 23:59
7. In-Cab Card Payments
There are no additional transaction fees for paying via card in the cab.
8. Toll & Congestion Charges
Fares include toll road charges but exclude congestion charges where applicable.
9. Re-Booking Policy
All bookings, including return trips, must be made through the Emelx website. Private hire drivers are not authorized to accept direct bookings. Any such journeys are illegal and not insured.
10. General Applications & Force Majeure
Emelx is not liable for delays, cancellations, or failures due to causes beyond our control, including but not limited to:
- Natural disasters, severe weather, or accidents
- Road closures, traffic congestion, or diversions
- War, terrorism, government actions, or civil unrest
- Industrial actions, strikes, or lockouts
- Flight delays or cancellations
- Power failures or technical breakdowns
Emelx is not liable for any indirect, incidental, or consequential damages, including missed flights, lost income, or additional expenses arising from delays or cancellations.
11. Pricing Policy
Fares are calculated based on distance, time of travel, passenger count, and vehicle type.
Prices are subject to change without prior notice. Clerical or typographical errors in pricing or invoices may be corrected without liability.
12. Waiting Time
- Airport pickups: First 60 minutes after actual landing are free. After that, $50/hour pro rata applies.
- Non-airport pickups: 10 minutes free. After that, $50/hour pro rata applies.
Passengers must ensure the contact phone number provided is reachable. Failure to make contact within the waiting time is considered a no-show with no refund.
13. Cancellation & Refund Policy
- Cancellations more than 24 hours before pickup: Full refund minus $10 or 10% (whichever is higher).
- Cancellations within 24 hours or no-shows: No refund.
Emelx reserves the right to cancel any reservation without notice for operational or safety reasons.
14. Terms of Carriage
- Passengers are responsible for booking in accordance with airline check-in requirements and allowing adequate travel time.
- Estimated travel times are suggestions only and not binding.
- Additional stops or diversions will incur extra charges.
- Emelx is not responsible for loss or damage to luggage. Passengers are responsible for loading/unloading luggage when accompanying it.
- Child seats are subject to availability. Parents are responsible for fitting seats.
15. Account Customers
- Invoices must be paid within 10 working days.
- Emelx may impose credit limits and suspend service if exceeded.
- Unauthorized use of account numbers is not the responsibility of Emelx.
16. Data & Privacy
We collect and process personal data in compliance with the California Consumer Privacy Act (CCPA) and federal privacy laws. See our Privacy Policy for details.
17. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California and applicable U.S. federal law. All disputes are subject to the exclusive jurisdiction of the courts of Orange County, California.
18. Updates
Emelx reserves the right to update these Terms & Conditions at any time without prior notice. Changes are effective immediately upon posting to this website.
